Part of business succession planning also entails having the right documents in place and updated to current standards, to protect your future beneficiary. Here are some documents samples that your business could benefit from:

Employee Contracts

Employment contracts will ordinarily cover:

  • Job title & scope of employment
  • Salary & benefits
  • Standards for evaluation
  • Length of employment
  • Grounds for termination

An employment contract is not necessary for every hiring. Most hires are actually conducted through at-will employment agreements, which do not limit the rights of either the employer or employee to terminate the arrangement.

Employee Training Manuals

Employee Training Manuals are essential for all organizations that want to clearly provide educational preparation for performing a job, that is typically provided to staff by the business that has recently hired them before they become active in service to the company. Employee training is required to assist the work force in using modern techniques, tools, strategies and materials in their jobs. Employee training manuals are also essential when the business model changes, the organization wants to implement cross training, or simply to reiterate specific tasks, or new systems.

Job Descriptions

Job descriptions are based on objective information obtained through job analysis, an understanding of the competencies and skills required to accomplish needed tasks, and the needs of the organization to produce work. They clearly identify and spell out the responsibilities of a specific job. Job descriptions also include information about working conditions, tools, equipment used, knowledge and skills needed, and relationships with other positions. The best job descriptions are living, breathing documents that are updated as responsibilities change. They do not limit employees, but rather, cause them to stretch their experience, grow their skills, and develop their ability to contribute within their organization.

Nondisclosure Agreement

A nondisclosure agreement occurs when one party or both parties to the agreement promise not to reveal any confidential information that the other is giving to them during the transaction. This is commonly used in employment contracts, where the employee promises not to reveal any confidential information obtained during the course of employment to outside sources. The purpose of the nondisclosure agreement is essentially to establish a confidential relationship between the employer and the employee that can easily be proved in a court of law.

Confidentiality Agreement

For business purposes is one made between an employee and employer agreeing that certain types of information that pass between the parties shall not be revealed to any other party employed or otherwise.

Non Compete Covenant

A non-compete covenant, non-compete clause, or covenant not to compete is a provision that prevents a former employee from working for a competitor or opening a competing business for a specified period after leaving the company. These provisions are found in employment contracts and can protect companies.
